Alan R. Johnston

Principal

Alan has been practicing business and construction law for more than 30 years. Throughout his career, he has found that, from time to time, attorneys and firms need assistance on a short- or long-term basis.  That’s where he comes in. He has a diverse background including 13 years as a research scientist at Scripps Clinic and Research Foundation before pursuing law in 1979.  In 1984, he became an associate at Duke Gerstel Shearer and Bregante, the preeminent construction defect law firm in California.  Just 4 years later, he became a partner in Duke Gerstel Shearer LLP.  From 2009 to 2012, he was the managing partner of Rupp Johnston & Lloyd LLP after which he joined the defense firm of Thomas Lucas as the senior litigation associate.  


He has practiced in all three areas of construction law representing plaintiff homeowner's associations, developers, and subcontractors from the inception of the matter through trial.  His unique background afforded him the training needed to analyze environmental toxic tort matters from an educated perspective. he has uncommon insight into complex medical-legal issues as well.

All of this combined ensures that he can help to develop the best case possible for your client and improve your bottom line. Additionally, he has engaged in hundreds of mediations over his career and understands perspectives from both sides of the table in mediations. He acts as a facilitator in ADR Mediation Services to help parties find a mutually beneficial resolution to their dispute, often using critical evaluative methods with each party as to the strengths and weaknesses of their legal position and then facilitating a successful  resolution.
